Defense of Drug Charges in Louisiana

Conviction on criminal drug charges in Louisiana state court or federal court carry the possibility of serious penalties, almost always including prison time.

With two offices - located in Lafayette, Louisiana and Baton Rouge, Louisiana, the Stockstill & Webre Trial Lawyers LLC,  defends people throughout southern and central Louisiana (including Lafayette, Lake Charles, New Orleans and Baton Rouge) who have been accused of all types of drug charges, including:

  • Possession of marijuana or other street drugs like cocaine or crystal meth: Marijuana is the only illegal drug for which possession is not an automatic felony
  • Manufacturing, cultivation or distribution of marijuana, Ecstasy or other illegal narcotics: If the charge involves trafficking or smuggling a significant amount across state lines, the charges could be prosecuted in federal court, with strict sentencing guidelines
  • Possession or distribution of prescription drugs like Loritabs, OxyContin, Valium or Xanax: These charges have become more common as rates of prescription drug abuse have risen over the years
  • Homicide charges against alleged drug dealers involving overdoses: under Louisiana law, a person who sells someone heroin or another Schedule 1 or Schedule 2 drug can be charged with homicide if that person later overdoses on the drug

A Baton Rouge, Lafayette & Lake Charles Criminal Defense Law Firm

Criminal defense lawyer J. Kevin Stockstill has more than 14 years' experience as a criminal defense attorney, defending clients accused of a wide range of criminal drug charges in both state and federal court.

Mr. Stockstill is fiercely dedicated to protecting the rights of his clients accused of criminal drug charges. Whether the case proceeds in state or federal court, Mr. Stockstill has the experience and dedication necessary to mount a strong defense on his clients' behalf.

Criminal Drug Charges Dismissed: Lafayette Metro Narcotics obtained a search warrant for our client's home. After conducting a search, they located 40 pounds of marijuana. We filed for and obtained a suppression hearing, arguing that the search warrant and search were unconstitutional. The judge, after considering the evidence and arguments of counsel, agreed with us and ordered the evidence of marijuana found in our client's home suppressed. This ruling prevented the prosecution from introducing the charge of marijuana possession at trial and they were forced to dismiss the case.

Civil Forfeiture Cases

In addition to defending clients against criminal drug charges, our law firm is also available to handle civil forfeiture cases. A forfeiture case is a civil proceeding in which the government attempts to seize cash or other property that it claims are proceeds from illegal activities such as narcotics distribution. In such cases, our law firm represents the person whose property has been seized — on a contingency basis. If we are able to force the government to return the property, then we accept attorney's fees as a percentage of the property value. If, however, we are unsuccessful, then we charge no fee to our clients in civil forfeiture cases.
